Welcome to Rivalists! These Terms of Service ("Terms") apply to your access and use of the Rivalists platform and services. By accessing or using Rivalists, you agree to these Terms. If you do not agree with these Terms, do not access or use Rivalists.
Persons under the age of 13, or any higher minimum age in the jurisdiction where that person resides, are not permitted to access or use the Rivalists Service unless their parent has consented in accordance with applicable law. Additionally, you cannot access or use the Rivalists Service if you are barred from receiving services under applicable law or have previously been suspended or removed from the Rivalists Service.
You may only connect to the Rivalists Service using (i) our mobile applications and software, or approved third-party applications, software, or devices; or (ii) our websites (“Authorized Connections”). You may not connect to the Rivalists Service through any unauthorized application or third-party connection. Any violation or attempted violation of this provision may result in the immediate termination of your ability to access the Rivalists Service. Rivalists allows users to upload, store, share, post, send, or display content (“Your Content”) on the platform. You retain all rights to Your Content that you post on Rivalists. By making Your Content available on Rivalists, you grant us a non-exclusive, worldwide, royalty-free license to use, copy, modify, publicly display, publicly perform, reproduce, translate, create derivative works from, and distribute Your Content for the purpose of providing and improving Rivalists.
You are solely responsible for Your Content. You represent and warrant that you own or have all necessary rights, licenses, and permissions to grant us the license to use Your Content as described in these Terms. You further represent and warrant that Your Content does not infringe, misappropriate, or violate any third party's intellectual property rights or any other rights.
You agree not to post, upload, or transmit any content that is unlawful, defamatory, abusive, obscene, vulgar, or otherwise objectionable. We reserve the right to remove or disable access to any content that violates these Terms or is otherwise objectionable.
Rivalists and its content are protected by copyright, trademark, and other laws of [country/region]. You acknowledge and agree that Rivalists and its content are the property of Rivalists or its licensors. You may not copy, modify, distribute, sell, or lease any part of Rivalists or its content without our express written permission.
Rivalists respects the intellectual property rights of others and expects its users to do the same. If you believe that your intellectual property rights have been violated on Rivalists, please contact us [contact information] with the following information: (a) a description of the copyrighted work or other intellectual property that you claim has been infringed; (b) a description of where the alleged infringing material is located on Rivalists; (c) your contact information; (d) a statement by you that you have a good faith belief that the use of the material is not authorized by the copyright owner; and (e) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
RIVALISTS IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE OPERATION OF RIVALISTS WILL BE UNINTERRUPTED OR ERROR-FREE.
RIVALISTS PROVIDES INFORMATION AND TOOLS FOR PHYSICAL THERAPISTS, TRAINERS, AND ATHLETES. HOWEVER, RIVALISTS DOES NOT PROVIDE MEDICAL ADVICE OR DIAGNOSIS. YOU SHOULD CONSULT WITH A QUALIFIED PROFESSIONAL BEFORE USING RIVALISTS OR RELYING ON ANY INFORMATION PROVIDED THROUGH RIVALISTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RIVALISTS OR ITS AFFILIATES, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF RIVALISTS OR THESE TERMS. OUR TOTAL LIABILITY TO YOU FOR ANY DAMAGES SHALL NOT EXCEED THE AMOUNT PAID BY YOU (IF ANY) TO RIVALISTS FOR THE USE OF RIVALISTS DURING THE SIX (6) MONTHS PRIOR TO THE DATE THE CLAIM AROSE.
We reserve the right to suspend or terminate your access to Rivalists or these Terms at any time and for any reason. Upon termination of these Terms or your access to Rivalists, you will no longer have the right to use or access Rivalists.
